Terms of Service

Article 1: General Provisions

1. These Terms of Use (hereinafter, the “Terms”) apply to all activities undertaken by users when using AiKano, an AI character chat service provided by the operator (hereinafter, the “Service”).
2. These Terms set forth the conditions for using the Service. Users shall use the Service in accordance with these Terms.
3. By using the Service, users are deemed to have agreed to all of the provisions set forth in these Terms.

Article 2: Amendments to These Terms of Use

1. We may amend these Terms of Use from time to time without obtaining the user's consent.
2. If we amend these Terms of Use, we will promptly post the amended version on the Service.
3. The amended Terms of Use will take effect when posted on the Service.

Article 3: Purpose of the Service

1. This Service is an interactive entertainment service provided by the Company to users that uses artificial intelligence (AI) technology to enable conversations with virtual characters.
2. All characters appearing in this Service (hereinafter referred to as “AI Characters”) are fictional and are not real people. Responses in this Service are generated by AI and the Company’s response system. Staff may be involved in some interactions to improve the quality of responses.
3. This Service is not intended to facilitate interaction between users and does not constitute an “Internet Dating Service” as defined under the Act on Regulation of Dating Services.

Article 4: Eligibility

1. This service is available only to individuals aged 18 or older.
2. High school students may not use this service, even if they are 18 or older.
3. By beginning to use this service, users represent and warrant to us that they are 18 or older (excluding high school students).
4. If we determine that a user is under 18, we will immediately suspend their use of this service.

Article 5: Notices from Us

1. We will notify users of any necessary information from time to time by posting it on the Service, sending an email, or using any other method we deem appropriate.
2. The notice described in the preceding paragraph will take effect when we post it on the Service or send it by email or other means.

Article 6: Account Management

1. Users are responsible for managing their account information.
2. We shall bear no responsibility whatsoever for any damages resulting from unauthorized use of an account.
3. Users may not hold multiple accounts or transfer or lend their account to another person.

Article 7: Fees

1. Each text chat message uses 5 points (equivalent to ¥50).
2. The price per point is ¥10 (including tax). Bonus points are awarded when you purchase points in bulk. For details about purchase plans, please see the Points Purchase page in the Service.
3. We award 25 free points when you sign up (enough for your first 5 messages). You can also earn a daily login bonus of 10 points, valid for 24 hours from when it is awarded.
4. Typical point costs: text chat, 5 points; premium content (such as videos), at the price displayed for each item. The number of points required may change without prior notice.
5. We offer the following monthly subscriptions: Standard Plan (¥2,980/month for 300 messages) and Premium Plan (¥4,980/month for 500 messages). After you exceed the monthly message allowance, you can continue using either plan at 3 points per message.
6. Monthly subscriptions are charged the full monthly fee on the sign-up date and then renew automatically for the same amount on that date each month (no proration). You can cancel at any time from the Plans page. After cancellation, no further charges are made and you can keep using the Service until the end of the period you have already paid for. No prorated refunds are given for the paid period.
7. Once payment for a paid service is completed, cancellations or refunds for the user's own reasons are not accepted due to the nature of digital content. However, if you were charged twice or could not use the Service due to a problem on our side, please contact us at info@tjym.org. We will review the matter and provide a refund or other remedy as appropriate.
8. We also offer 30-day passes payable at convenience stores (Standard: ¥2,980; Premium: ¥4,980). 30-day passes do not renew automatically.
9. Due to the nature of digital content, purchases of points and 30-day passes are non-refundable.
10. Purchased points do not expire. However, points awarded as a login bonus are valid for 24 hours from when they are awarded.
11. When you close your account, all points you own will be deleted.
12. You are responsible for any communication charges and other costs required to use the Service.
13. When using paid services, you will not be charged any additional amounts under labels such as interest, administrative fees, or late fees.
14. The Service is for entertainment purposes. Purchasing points gives you the right to use digital content in exchange for payment. Points are not intended for investment, earning income, or exchange for cash.

Article 8: AI Characters (Important)

1. All AI characters featured in this service are fictional and have no connection whatsoever to any real person, organization, character, or other entity.
2. Responses on this service are generated by AI and our response system. To improve response quality, staff may be involved in some interactions. We do not guarantee the accuracy, appropriateness, or truthfulness of any responses.
3. Because AI character responses are probabilistically generated based on training data, they may include content that differs from users’ expectations, is contradictory, or is inaccurate.
4. Users must not rely on AI character responses as real-world advice or as professional advice on medical, legal, financial, or other matters.
5. Conversations with AI characters are for entertainment purposes. We accept no liability if a user develops emotional dependence or experiences other adverse effects on their real life as a result of using this service.
6. AI characters are set up as fictional individuals aged 18 or older. Characters whose ages are not explicitly stated are also all depicted as adults aged 18 or older.

Article 9: Prohibited Conduct

Users must not engage in any of the following acts when using the Service:

1. Violating these Terms of Use
2. Engaging in conduct that violates laws or regulations or public order and morality
3. Engaging in conduct for commercial purposes, affiliate marketing, advertising, solicitation, or similar purposes
4. Requesting settings or depictions for AI characters that suggest a person under the age of 18
5. Generating or prompting content involving child pornography, child abuse, incest (depicting relationships suggestive of real-life family relationships), or imitation of real people (such as entertainers or other public figures)
6. Generating or prompting content through AI characters that encourages crime, suicide, self-harm, drug use, or other illegal or harmful conduct
7. Redistributing, reselling, or publishing AI-generated content obtained through the Service to third parties
8. Misrepresenting an AI character's responses as statements made by a real person
9. Infringing or potentially infringing the copyrights, trademarks, or other intellectual property rights of other users, third parties, or the Company
10. Infringing the property, privacy, portrait, or publicity rights of other users, third parties, or the Company
11. Discriminating against, defaming, or slandering other users, third parties, or the Company, or damaging their reputation or credibility
12. Interfering with the Company's operation of the Service
13. Using the Service while impersonating a third party
14. Attempting to gain unauthorized access to the Service, reverse engineer it, or extract its AI models
15. Using responses from the Service as training data for training other AI models
16. A single user holding multiple accounts
17. Multiple users sharing the same account
18. Transferring or lending an account for the Service
19. Encouraging any of the acts listed above
20. Any other conduct that the Company deems inappropriate

If the Company discovers that a user has engaged in any of the prohibited conduct listed above, it may suspend the user's access to the Service or terminate their membership without prior notice.

Article 10: Withdrawal

1. Users may stop using and withdraw from the Service at any time in accordance with these Terms and the procedures established by the Company.
2. You can complete the withdrawal process in Settings on your My Page.
3. From the time a withdrawal request is submitted until withdrawal is completed, the withdrawal will be processed immediately, provided there are no issues with the user's account.
4. If a certain period (180 days or more) has passed since a user's last login, the user will be considered to have withdrawn from the Service.
5. Upon withdrawing from the Service, users will lose all rights as members, including the right to use the Service and the right to receive information through the Service's notification features.
6. When a user withdraws from the Service, all points held by the user will be deleted. Purchased points are non-refundable.
7. No fees or other charges will be incurred for withdrawing from the Service.
8. If a user engages in any prohibited conduct set forth in Article 9, the Company may withdraw that user from the Service without prior notice.
9. The Company shall not be liable for any damages incurred by a user who has been withdrawn from the Service.

Article 11: Handling of Chat Data

1. We may store and analyze chat content between users and AI characters to improve our services, enhance the quality of AI responses, detect misuse, and comply with applicable laws and regulations.
2. We may use chat content to improve our services and train AI after processing it so that individuals cannot be identified.
3. If illegal activity (such as requests for child sexual abuse material or encouragement of criminal activity) is detected, we may preserve the relevant chat logs as evidence and provide them to law enforcement authorities when necessary.
4. Any personal information entered by users (such as their real name, address, or phone number) is entered at the user's own responsibility. We are not liable for any damages resulting from such information.

Article 12: Advertising

1. We may provide users with advertisements from us and our advertisers through the Service.
2. We do not guarantee the content of services provided to users by advertisers, nor are we responsible for the results of those services.
3. Users agree to hold us harmless from any loss or damage resulting from their use of advertisements or any actions arising from such use.

Article 13: Deletion of Information

1. If we confirm that a user has engaged in any prohibited conduct specified in Article 9 of these Terms of Use, we will delete information related to that conduct without prior notice to the user.
2. If a user inquires about a deletion under the preceding paragraph, we will have no obligation whatsoever to explain the reason for the deletion.

Article 14: Disclaimer

1. We make no warranties whatsoever regarding the accuracy, reliability, usefulness, legality, currency, or any other aspect of the information provided to users through the Service, including responses from AI characters.
2. We shall not be liable for any mental, physical, or financial harm suffered by users as a result of responses from AI characters.
3. The Service is intended for entertainment purposes. AI characters are not a substitute for real-life relationships, medical advice, legal advice, financial advice, or other professional advice.
4. If a user develops a psychological dependency as a result of using the Service, we shall not be liable and recommend consulting a qualified healthcare professional when appropriate.
5. We shall not be liable for any consequences arising from a user's use of the Service or from any malfunction or interruption of the Service.
6. Users understand and agree that AI technology is still developing and that they may not receive the responses they expect.

Article 15: Termination of the Service

1. We may notify users and discontinue the provision of the Service, or any part of the Service, to users at any time.

Article 16: Suspension of the Service

We may temporarily suspend the provision of the Service without prior notice to users in any of the following cases:

1. When necessary for the maintenance or construction of facilities used to provide the Service
2. When a failure occurs in facilities used to provide the Service
3. When a failure occurs in an AI foundation model (external API services such as OpenAI or Anthropic)
4. When we determine that temporarily suspending the Service is necessary due to other operational or technical issues

Article 17: Handling of Personal Information

1. We will appropriately protect users’ personal information and comply with the Privacy Policy, which is posted separately on this service.

Article 18: Intellectual Property Rights

1. The User acknowledges and agrees that information provided to the User by us through this Service (including character profiles, illustrations, text, audio, software, etc.) is protected by copyright, trademark rights, patent rights, other intellectual property rights, and applicable laws.
2. Ownership of the copyright in content generated by AI through this Service (including chat content, generated images, etc.) shall be determined separately by us. Users may not use such content commercially, redistribute it, or distribute it further.
3. All rights to the names, profiles, visuals, and other attributes of AI characters belong to us.

Article 19: Claims for Damages

1. If a user violates these Terms of Use or uses the Service unlawfully and causes damage to our company, we may seek appropriate compensation for the damages.

Article 20: Governing Law and Jurisdiction

1. These Terms of Use shall be governed by the laws of Japan.
2. In the event of any dispute arising in connection with the use of this Service, the parties agree that, depending on the amount in controversy, the Osaka District Court or the Osaka Summary Court shall have agreed jurisdiction as the court of first instance.

Article 21: Age Verification

1. As this service includes romance-themed conversations, it may be used only by people aged 18 or older, excluding high school students.
2. When beginning to use this service, users must declare that they are at least 18 years old.
3. If we determine, based on information provided by a user, their usage patterns, or other reasonable means, that the user is under 18, we may suspend their use of the service and delete their account.
4. If we discover that a user is under 18, we will not refund any purchased points, except in cases where a contract is canceled by a minor.

Article 22: Miscellaneous

1. If any issue arises between the user and the Company, both parties shall discuss it in good faith and endeavor to resolve it.
2. Any matters concerning the use of this Service that are not set forth in these Terms of Use shall be governed by provisions separately established by the Company.
